Notarizations in Washington State

How do I get a document notarized in Washington State?

In the state of Washington, any signer wanting to have a document notarized must be at least 18 years of age and  have a US driver's license, US passport, armed forces military ID, or an approved government-issued photo ID. *Please note that in the case of ID needing to be photocopied to accompany notarized form, it is illegal to copy a military ID.

The signer must be coherent, understand the document to be signed, and willing to sign the document in front of the notary with no guidance or pressure from any other party.

What type of documents can be notarized in Washington State?

The most common types of documents requested to be notarized are Affidavits, Car Titles, Financial or Medical Power of Attorney forms, Real Estate Documents, Minor Consent to Travel forms, Trust Documents, Wills, and more.

*Please note that certain documents, such as vital records, (ie. birth and death certificates) must be notarized by the issuing government agency. Always check with your notary whether or not your document can be notarized by them.

What happens during a mobile notary appointment?

I will first ask to see your valid Driver's License, Passport, or another form of acceptable government-issued

I will look over the document to be notarized to make sure I am legally allowed to notarize it.

I will record ID information and the title and dates of the documents in my notary journal.

I will ask you to sign my notary journal and place your thumbprint next to your signature.

I will administer an oath if needed and watch you sign the documents.

I will complete my notarial certificate, sign, and stamp it.

What happens if my document does not have a notarial certificate?

In the event that a notarial certificate is not attached to your document, and you are unsure which one is needed, you should contact the issuing or receiving agency or an attorney to assist you in determining the correct certificate required.

Can the notary public give you advice about a document, recommend the type of notarization certificate required?

Absolutely not, and here is why. A notary public is not an attorney and therefore, by law, cannot explain or interpret the contents of any document for you, instruct you on how to complete a document, or direct you on the advisability of signing a particular document.

By doing so the notary would be engaging in the unauthorized practice of law and could face legal penalties that include the possibility of incarceration. Any important questions about your document should be addressed to the lender, title company, or attorney.
